Terms and Conditions of Sale | Echo Blinddog

1. Introduction

These Terms and Conditions of Sale | Echo Blinddog (T&Cs) govern the contractual relationship between:
Echo-Blinddog, a sole proprietorship registered in France under SIRET number 983 981 853 00010, with its registered office at 9 rue du Travail, 67640 Fegersheim, France, hereinafter referred to as “the Seller,”
and any individual or legal entity making a purchase on the website www.echo-blinddog.com, hereinafter referred to as “the Customer.”

These terms apply to all orders placed on the website www.echo-blinddog.com and take precedence over any other document. By placing an order, the Customer agrees without reservation to these T&Cs.

2. Products

The products offered for sale on the website www.echo-blinddog.com are described as accurately as possible.

• Availability: Product offers are valid as long as they are visible on the website and subject to stock availability.
• Accuracy: Product photographs and descriptions are non-contractual. If in doubt, the Customer may contact customer service for further details at admin@echo-blinddog.com.

3. Orders

To place an order, the Customer must:

1. Select the desired products and add them to the shopping cart.
2. Validate the shopping cart and provide the necessary delivery and payment information.
3. Accept these T&Cs by ticking the corresponding box.
4. Complete the payment using the available payment options.

Once the order is validated, a confirmation email will be sent to the Customer.

The Seller reserves the right to cancel or refuse any order for legitimate reasons (e.g., previous disputes, payment issues, etc.).

4. Pricing and Payment

• Pricing: Product prices are listed in euros (€), inclusive of all taxes (TTC). Delivery costs are not included in the product prices and will be specified before order validation.
• Payment: Payment is made online via the following methods: credit card, PayPal, or any other payment option offered on the website.

Orders will only be processed after full payment has been received.

5. Delivery

• Delivery areas: Products are delivered to the areas specified on the website, including France and international destinations.
• Delivery times: Estimated delivery times are provided at the time of order. In the event of a delay, the Customer will be informed. If the delay exceeds 30 days, the Customer may cancel the order.
• Delivery costs: Delivery charges are calculated based on the destination and the weight of the items.

The Seller is not responsible for delivery delays or failures caused by events beyond their control (e.g., strikes, force majeure, etc.).

6. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has the right to withdraw from the purchase within 14 calendar days of receiving the products, without providing any reason or incurring penalties.

• Exercising the right of withdrawal: The Customer must notify their decision by email at admin@echo-blinddog.com or by using the withdrawal form available on the website.
• Returning products: Products must be returned in their original condition, unused, and in their original packaging to the following address:
  Echo-Blinddog, 9 rue du Travail, 67640 Fegersheim, France.
  Return shipping costs are the responsibility of the Customer.
• Refunds: The Seller will refund the Customer within 14 days of receiving the returned products.

Exceptions to the right of withdrawal: This right does not apply to customized or made-to-order products.

7. Legal Warranty

The products sold on the website are covered by the legal warranties provided under Articles L217-4 and following of the French Consumer Code and 1641 and following of the French Civil Code:

• Legal warranty of conformity: The Seller guarantees that the products delivered conform to the description and are free from defects.
• Warranty against hidden defects: The Customer may seek repair or reimbursement for a defect that renders the product unfit for its intended use.

8. Liability

The Seller shall not be held liable for any damage resulting from improper use of the product by the Customer or failure to follow the provided instructions.

Similarly, the Seller disclaims liability for indirect damages related to the use of the website or the products sold.

The Customer’s personal data is collected and processed in accordance with the privacy policy available on the website.

The Customer has the right to access, rectify, delete, and oppose the processing of their personal data in accordance with the GDPR. For any request, contact admin@echo-blinddog.com.

10. Intellectual Property

All elements of the website www.echo-blinddog.com (texts, images, logo, etc.) are protected by intellectual property rights. Any reproduction, in whole or in part, is strictly prohibited without prior authorization.

11. Applicable Law and Dispute Resolution

These T&Cs are governed by French law.

In the event of a dispute, an amicable solution will be sought before initiating any legal action. If no amicable resolution is reached, the Customer may refer the matter to the competent French courts or contact a consumer mediator.
